This guide is meant as a rational and level-headed guide for the victims of Richard Scoville and the FreeSpeechStore. There are many FAQs and sites that describe Mr Scoville and his site, so this guide will not attempt to duplicate them.
Briefly, however: www.freespeechstore.com is what is known as a pay-for-libel (PFL) website. This is a relatively old scam that works like this:
PFL owner writes a defamatory article about their victim and posts a summary to the website, allowing the public to see a highly insulting/salacious title and one or two sentances of the libel.
PFL owner then posts dozens, if not hundreds, of messages containing allegations against the victim in various newsgroups and web forums, containing the false allegations against the victim and pointing back to the PFL site "for all the details"
The idea is to appeal to the darker curiosity of people by teasing them to click to read more of the "dirty gossip". The user is then asked for a small fee to read more (In FreeSpeechStore's case, US$3.99)
The use of a small fee (Usually less than ten dollars) relies on the principal that people will think "It's only five bucks, what the heck". Multiply this by several hundred people thinking the same thing and the PFL owner now has a few thousand dollars for their efforts.
The PFL owner will suggest that the victim is able to remove the posts about themselves, or rebut the accusations, but these are all invariably used as "evidence" of their guilt, usually with outragous arguments to support it, in order to increase the visibility of the salacious gossip.
Keyword loading / Google Spamming as a Scoville tactic FreeSpeechStore / Richard Scoville takes this to another step, however: He has been engaging, for several years, in what is known as "Keyword loading" or "Google Spamming" dozens of Usenet newsgroups. It works like this:
He will post his false accusations to several usenet newsgroups, always using the victims name and several inflammatory and false accusations in the subject header of the post. The subject header is what is important here, as seen below.
Many people, thinking that they are being good samaritans, will respond to the posts, either defending the victim or insulting the PFL owner, with the intent of refuting the PFL intent. What most people invariably fail to do, however, is to change the subject line of the post.
The intent of Richard Scoville is to ensure that whenever someone performs a Google search for his victim's name, employer or business, that his pay-for-libel posts come up first. Given that he posts dozens of these accusations and he will get dozens or hundreds of people replying to him but not changing the subject lines, the pay-for-libel subject header appears as the first dozen or several dozen search results.
Even if the person doing the search does not click through to the articles themselves, Richard Scoville's intent is still successful: To expose the reader to his libellous accusations in the subject headers, which is what Google always returns in their search results listing.
If you are attacked / targeted by Richard Scoville, here are the steps you should take to ensure minimum disruption:
Contact your ISP and explain the situation to them: Ask them, while on the phone, to simply Google for the term "freespeechstore" in order to first establish context. This is important, so that the person you are speaking with does not feel that this is solely a matter of your opinion. A Google search very quickly reveals that "freespeechstore" is both a pay-for-libel website, as well as an individual who's modus operundi is to attempt to cancel the internet and usenet accounts of those he disagrees with. Ask your ISP to put a note on your account showing that you are the victim/target of a pay-for-libel website owner. This is simply to avoid some over-zealous tech support or abuse-desk operator from suspending your account without first checking the facts. If you are a website owner/operator, do the same thing with your web host: This will save you a lot of time. If you can help it, do not respond to Richard Scoville or FreeSpeechStore posts: He will simply use it as fuel for further libel attacks. (If you do respond, see the "tips on replying to Scoville", below)
If you must reply to Richard Scoville / FreeSpeechStore The first best method is not to reply at all, but to forward his post, including full headers, to: His ISP, his news service provider (usually google, but often AOL) and his web host provider
Remember that replying to Scoville's posts merely serves his purpose in extending the life of his pay-for-libel attacks and increasing the google rankings of his attacks. That being said; If you are going to reply to him:
Tips on replying to Richard Scoville / Freespeechstore Change the subject line: Remove your name/company and his accusations. Usually, chaging it to "Re: Another FreeSpeechStore/Richard Scoville attack" is both sufficient and accurate. Snip/delete the bulk of his content, especially the names, email addresses and "keyword lists" from his post before replying. Again, quoting these only furthers his goals of smearing you or the victim you think you are helping by responding to defend Keep your response short, to-the-point, accurate and professional. Sinking to simple name-calling makes you look as bad as he does. Remember, though: The best tactic is to ignore him. As many experts will tell you "Feeding the trolls is hazardous to your health"
One more reminder: Richard Scoville has threatened hundreds of people with lawsuits and very, very rarely follows through with them. When he does, he loses. His most recent courtroom attack was against ahbl.org, which was thrown out of court for lack of jurisdiction. He has sued the Wall Street Journal and lost, costing him roughly US$800,000 in damages and has been the defendant in more than a dozen court cases in his home town of San Antonio, Texas.
