We send out four Qualified Written Requests (QWR) with interrogatory. First, they’re going to your lender and their regulators. Upon receipt, the lender has 20 days to acknowledge the subpoenas and 60 days to produce the documents for the QWR. When the client receives the documents they must forward them to Rivera Document Processing, LLC for a forensic investigation.
What is a Quiet Title action?
Regarding the context of property financed through a mortgage loan that has been rescinded the legal action to remove the lien is known as Quieting Title. This is an operation of law. A Quiet Title action is a court procedure that is required in order to get a court order confirming that the procedures undertaken by the homeowner in performing rescission was done in accordance with the Truth in Lending Act. Thus, when the 20 day requirement for the mortgage lender fails to tender, the title should be free and clear of any liens or encumbrances by operation of law. Quiet Title is a method of taking adverse possession (changing the title/deed of the property from one person to another person by taking control through legal action instead of purchase). It is a means of involuntary transfer by operation of law. An action to quiet title is a lawsuit filed to establish ownership of real property (land and buildings affixed to land). The plaintiff in a quiet title action seeks a court order that prevents the respondent from making any subsequent claim to the property. Quiet title actions are necessary because real estate may change hands often, and it is not always easy to determine who has the title to the property.
Securitization and Foreclosure
Parties attempting to foreclose a securitized loan are often not legally entitled to do so. They are not the real parties of interest and have no standing to foreclose and can be challenged on several fronts. Tracking what happens to the note and the deed of trust during the securitization process will expose the problems and issues.
Proper Securitization
When a loan is securitized, it is bundled with other loans and ends up in a trust, whose shares are sold to investors (certificate holders). To achieve the goals of the securitization and to avoid double taxation, a loan must follow an exact process within a fixed period of time. This process requires that there are true sales and an unbroken chain of assignments between all parties in the process and that all loans enter the trust by the closing date, which is like a steel door that cannot be opened after the closing date.
