I noticed you pulled down my legal notice from timedealz.com.

I worked with you before in the past on the legal issues surrounding Simplefy.com. As you recall Greg Wooten and I had an ongoing change battle over what was displayed on AboutUs.org about Simplefy since both parties were claiming ownership and the matter was in litigation. As you recall, my side won. In addition to Simplefy.com, we also gained control of and changed esimplefy.com since my side owns the trademark for Simplêfy and acquired esimplefy from the defendants in court. I am still with Simplêfy and I am now also working for Joseph Einsidler, the original registrant for timedealz.com and the creator and owner of the trademark, TimeDealz.

The Simplêfy litigation started when Julie Borges, the VP of Simplêfy, found out she was going to be fired. She immediately filed a trademark application for the mark Simplêfy and sued us. We counter sued her. We won. This present issue over TimeDealz.com began in a similar way:

In May of 2006 Joseph Einsidler, an elderly businessman in New York, registered the domain name TimeDealz.com and hired a web design firm to develop his website. Sonal Sethi was an employee of that firm. When Sonal Sethi did not make the changes to the website requested by Joseph Einsidler, his employment was terminated. In June of 2007, Sonal Sethi, now no longer an employee, made a change to the domain records naming himself as administrative contact. In September of 2007, Sonal Sethi made some more changes to the domain records, this time changing Joseph Einsidler's mailing address to point to his address so that when Tucows sent out the domain ownership change authorization it would be intercepted by Sonal Sethi who then illegally signed the document by fraudulently representing himself to be Joe Einsidler. Joseph Einsidler then had to register the domains TimeDealz.net and TimeDealz.org to continue his business, TimeDealz, which sells premium watches at discounted prices.

In May of 2008, Sonal Sethi, removed his infringing site and left the domain in a parked state whereby Network Solutions has continued to display links to competing watch companies. As a result of that, demand has been made upon Network Solutions to cease and desist the infringing use of the trademark TimeDealz and to return the stolen domain back to Joseph Einsidler.

You can check the following sources for verification of TimeDealz.com: 1.Domain History from DomainTools.com 2.Wayback Machine at Archive.org. 3.I can also email you my screen shots of the domain history, trademark page, and small claims judgment against Sonal Sethi.

As mentioned above, Sonal Sethi, has not had any active website posted at TimeDealz.com since May of 2008 and Network Solutions has been using the URL for simple link advertising purposes.

The question we have before us now is what should be displayed on AboutUs.org with regard to TimeDealz.com?

The ethical answer would be that, if anything is displayed at all about TimeDealz, it should be information that identifies and promotes Joseph Einsidler's version of TimeDealz and points people to TimeDealz.net instead of to the infringing page used by Network Solutions to display links.

The legal answer would be, if the first option is not chosen, TimeDealz.com should be completely removed from display on AboutUs.org since it’s present usage is also infringing upon the trademark of Joseph Einsidler and causing damages to his business, not only by Network Solutions but by AboutUs.org in that it is displaying Google Links to competing watch companies.

A third option is to leave the present information up so long as there is a clearly displayed legal notice near the top stating the truthful facts:

1. That the domain name was stolen. It would not be necessary to name Sonal Sethi.

2. That there is a trademark infringement issue pending litigation. It would not be necessary to name Network Solutions.

3. That no valid website exists on TimeDealz.com - only hyperlinks to other watch dealers are displayed.

4. That because of the foregoing, the proper website to visit is TimeDealz.Net.

We would further request that if you choose the third option that you only provide links to watch repair companies, not watch dealers, since TimeDealz does not perform watch repairs.

A Wiki should display honest and correct information to the public and not harm the legitimate rights of others. The key word here is “legitimate.” Neither Sonal Sethi nor Network Solutions has a legitimate claim to TimeDealz.com any more than a hacker would to your bank account or AboutUs.org's bank account.

Please let me know how AboutUs.org would like to resolve or handle this matter.
