In the Commonwealth of Massachusetts' Constitution, The office of Justice of the Peace is one of the oldest public officer appointments established. The Justice of the Peace was originally appointed as a Conservator of the Peace. A Justice of the Peace is authorized to make acknowledgements in the same manner as a Notary Public. Justices are also authorized to administer certain oaths of office. Oaths may be administered to Town Clerks, to a creditor during insolvency proceedings, to officials of religious societies, municipal employees, and in probate court proceedings. A Justice may take, upon request, depositions within the Commonwealth by administering written interrogatories unless otherwise provided by court. Unless a Justice of the Peace is also an Attorney he/she cannot act as an Attorney-At-Law. Today Justices of the Peace are mostly called on to solemnize marriages. A Massachusetts Justice of the Peace can solemnize a marriage anywhere in the Commonwealth, if he/she has been designated and qualified for such authority. The fee charged by a Massachusetts Justice of the Peace is determined by the laws of Massachusetts. Currently a Justice of the Peace who is designated to solemnize marriages may charge a maximum fee of seventy-five dollars to solemnize a marriage within their home community or a maximum of one hundred and twenty five dollars if the ceremony is performed in any other municipality in the Commonwealth. Additional charges are allowed for prenuptial counseling, conferences, rehearsals, and other special requests by the couple whose marriage is being solemnized. There is no limit on fees relating to renewal of vows for previously married couples.
