The public email system relies on an assumption, that sender and recipient are willing to share the cost because each message is of benefit to both.
Email that the sender can't reasonably expect the recipient to welcome is unsolicited. The best way to be sure is to exchange emails, one to one, establishing permission. If you're running a mailing list, have your list management software reply to a subscription request with a unique, unpredictable piece of information. Only subscribe the address if they send it back. That's called confirmed opt-in. Spammers call it "double opt-in" to make it sound difficult. All modern mailing list management software does it for you automatically, by default.
